Lift Plastic Surgery PLLC offers separate consent choices for transactional SMS and marketing or promotional SMS. Neither box may be preselected. Marketing consent is optional and is not a condition of purchase or treatment.

Message frequency may vary. Message and data rates may apply. Reply STOP to opt out and HELP for help. Most major U.S. carriers are supported. Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with third parties for their own use, except with service providers strictly required to deliver the messages the user consented to receive.

1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of https://liftplastics.com, related pages, forms, appointment or consultation tools, text messaging programs, and other digital services controlled by Lift Plastic Surgery PLLC (collectively, the “Services”). Lift Plastic Surgery PLLC may be referred to as “Lift Plastic Surgery,” “we,” “us,” or “our.” By accessing or using the Services, submitting a form, creating an account, booking a consultation or appointment, or otherwise interacting with us, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Services. Merely using the website does not enroll you in SMS marketing; marketing texts require a separate affirmative opt-in. Website descriptions are general information and are not a diagnosis, treatment plan, guarantee, quote, or substitute for an in-person clinical evaluation and informed consent.

3. SMS Communications

SMS participation is voluntary. You must provide a valid mobile number that you own or are authorized to use and make an affirmative selection through a consent-based channel. Transactional and marketing permissions are separate. Consent may be recorded electronically, including the language shown, source page, date and time, IP address, and checkbox selection.

3.1 Transactional SMS Consent

By checking the transactional SMS consent box, you consent to receive transactional messages related to your account, inquiries, consultations, appointments, care coordination, billing, procedures, treatments, or services you have requested from Lift Plastic Surgery PLLC. 3.4 Message Frequency

Message frequency may vary depending on your inquiries, consultations, appointments, procedures, care needs, account activity, and marketing preferences. Transactional message volume is event-driven. Marketing messages may recur until you opt out.

3.3 Opt-In Source

Patients and prospective patients may opt in by entering their telephone number into a website form, booking or consultation form, contact form, checkout or payment form, calendar form, landing-page form, patient intake workflow, or another consent-based channel that includes clear SMS consent language and links to the Privacy Policy and these Terms. Checkboxes must be separate, optional, and unchecked by default.

3.5 Opt-Out Instructions

Reply STOP to opt out of SMS messages. We may send a single confirmation of your opt-out. You may also call +1 832-835-1131 or email contact@liftplastics.com to revoke consent. An opt-out does not cancel an appointment, procedure, account, or service; contact the practice separately for those requests.

3.7 Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, device, network availability, and other factors outside our control, and is not guaranteed.

3.8 Message and Data Rates

Message and data rates may apply according to your wireless plan. You are responsible for charges imposed by your mobile provider. Lift Plastic Surgery does not charge a separate fee merely to receive an SMS, although services, products, appointments, or transactions referenced in a message may have separate charges.

3.9 Supported Carriers

The SMS program is intended to work with most major U.S. carriers, including AT&T, T-Mobile, Verizon, and participating regional carriers. Carrier participation and features may change without notice. Contact your carrier for plan and device questions.

3.10 Age Restriction

You must be at least 18 years old and the subscriber or customary user of the mobile number to enroll in marketing SMS. A parent or legal guardian may provide consent for service-related communications concerning a minor when legally appropriate. By opting in, you represent that you have authority to consent for the number provided.

4. Privacy Policy and SMS Compliance

Our collection and handling of information are described in the Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not share opt-in information, including phone numbers and consent records, with affiliates or third parties for marketing, promotional, or lead-generation purposes. Text-messaging originator opt-in data and consent will not be shared with third parties for their own use. It may be disclosed only to service providers, subcontractors, communications platforms, and carriers strictly required to deliver or support the messages you consented to receive, and subject to appropriate restrictions. All other use-case categories exclude text-messaging originator opt-in data and consent. We do not sell, rent, trade, purchase, or transfer leads or personal information. SMS consent is channel- and purpose-specific. A transactional opt-in does not create marketing consent, and an email or telephone consent does not automatically create SMS marketing consent. 5. Patient Responsibilities

You agree to provide accurate, current, and complete information; update contact and health information when it changes; attend or timely reschedule appointments; follow clinical and safety instructions; disclose relevant medical history, medications, allergies, nicotine use, pregnancy status, prior procedures, and other information requested by the care team; and ask questions when instructions are unclear. You are responsible for protecting access to your telephone, email, portal credentials, and devices. Notify us if a telephone number is reassigned, lost, or no longer under your control. Do not submit another person’s information without authorization. You are responsible for arranging transportation, an adult caregiver, postoperative support, medication compliance, and activity restrictions when instructed for a procedure. Aesthetic goals, candidacy, risks, benefits, alternatives, recovery, and expected outcomes must be discussed with a qualified provider. Information omitted or misrepresented may affect safety, eligibility, scheduling, or results and may be grounds to postpone or decline care.

6. Consultations, Appointments, Procedures, and Cancellations

A website or form submission is a request, not a confirmed appointment. An appointment is confirmed only after Lift Plastic Surgery provides confirmation and any required deposit, forms, or prerequisites are completed. Appointment and procedure availability may change because of clinical needs, emergencies, provider availability, facility requirements, weather, safety considerations, or events outside our control. Consultation, appointment, cancellation, rescheduling, no-show, deposit, and refund requirements may be provided at booking or in a separate financial or surgical policy. You agree to those disclosed requirements. We may charge a permitted cancellation, rescheduling, or no-show fee when stated in advance. Procedure dates may require additional deposits and preoperative clearance. Unless a separate written policy states otherwise, submitting an online request does not guarantee a particular date, provider, procedure, technique, price, or outcome. Lift Plastic Surgery may postpone, modify, or decline a service when a provider determines that it is not medically appropriate, required information or clearance is missing, payment requirements are unmet, safety is at issue, conduct is disruptive, or applicable law or professional standards require it. Clinical judgment and patient safety take priority over online descriptions or scheduling preferences.

7. Payment and Billing

Fees, estimates, deposits, membership charges, product prices, financing terms, and payment schedules are provided separately and may change before a binding agreement is completed. Unless we expressly agree otherwise in writing, services are offered on a cash-pay basis. You are responsible for charges incurred for consultations, procedures, treatments, products, memberships, cancellation or no-show fees, and related services, together with applicable taxes or collection costs permitted by law. An estimate is not a guarantee of the final cost. Additional care, testing, anesthesia, facility charges, implants, medications, garments, pathology, revisions, complications, or other services may result in additional fees. Any insurance or reimbursement assistance does not guarantee coverage or payment. You remain responsible for amounts not paid by a third party unless law or a written agreement states otherwise. Third-party financing and payment providers operate under their own terms, approvals, privacy practices, interest rates, and fees. Lift Plastic Surgery does not guarantee financing approval and is not responsible for a financing provider’s independent decisions or systems. Chargebacks, returned payments, and disputed transactions do not cancel valid payment obligations.

8. Industry-Specific Compliance

Healthcare services are provided by appropriately licensed professionals within their scope of practice and subject to applicable federal and Texas law, professional standards, informed-consent requirements, facility rules, and clinical judgment. We intend to handle protected health information in accordance with HIPAA, the HITECH Act, applicable Texas medical-privacy requirements, and our Notice of Privacy Practices where those laws apply. Before a procedure or treatment, you may be required to complete medical screening, provide records, obtain clearance, review risks and alternatives, and sign procedure-specific informed consent. Website content, electronic acceptance of these Terms, or SMS consent is not a substitute for procedure-specific informed consent. Clinical records may be retained as required by law and professional obligations. Text messaging is used for convenience and may not be encrypted. Sensitive clinical content may be redirected to a secure channel. Marketing authorizations for identifiable patient photographs, testimonials, or protected health information are separate from consent for treatment and separate from SMS consent.

9. Limitations of Services

A physician-patient relationship is established only through appropriate clinical evaluation and acceptance by a qualified provider under applicable practice procedures. Do not delay or disregard professional medical advice because of website content. Plastic surgery, aesthetic treatments, injectables, laser services, medical weight management, and other services involve individual risks, benefits, limitations, recovery requirements, and possible complications. Results vary based on anatomy, health, healing, lifestyle, adherence, technique, and other factors. No result, image, review, testimonial, price, simulator output, or description is promised or guaranteed. AI-assisted or digital aesthetic simulators are visualization and educational tools only. Outputs may be inaccurate, incomplete, or unrealistic and are not a medical assessment, surgical plan, predicted result, or guarantee. A provider’s clinical evaluation and written care plan control. Medical emergency: Do not use the Services, a website form, email, voicemail, or SMS for an emergency. Call 911 or go to the nearest emergency department. Established patients with urgent postoperative concerns should use the emergency or after-hours instructions supplied by the clinical team.

10. Children and Minors

The website is intended for a general adult audience and is not directed to children under 13. A person under 18 may use the Services only with the involvement and permission of a parent or legal guardian where required. Medical services for minors are subject to provider judgment, applicable consent and confidentiality law, parental or guardian authorization, and procedure-specific requirements. Marketing SMS enrollment is restricted to individuals 18 or older. If a parent or guardian provides service-related contact information concerning a minor, that person represents that they are authorized to receive those communications.

11. Acceptable Use

You may not misuse the Services. Prohibited conduct includes:
  • Providing false, fraudulent, misleading, unlawful, or unauthorized information or impersonating another person.
  • Attempting to gain unauthorized access to the website, accounts, systems, records, or networks, or interfering with security or operation.

12. Intellectual Property Rights

The Services and their text, design, graphics, logos, trademarks, photographs, videos, software, arrangement, and other content are owned by or licensed to Lift Plastic Surgery and are protected by intellectual-property and other laws. Patient images remain subject to separate consent and privacy requirements. Use of a third-party service is at your discretion and may require a separate agreement. A link does not necessarily imply endorsement. 14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND DIGITAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LIFT PLASTIC SURGERY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT CONCERNING THE WEBSITE AND DIGITAL SERVICES. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS. Medical services themselves are governed by applicable professional standards, informed-consent documents, and non-waivable legal duties. Nothing in these Terms disclaims or limits an obligation or liability that cannot lawfully be disclaimed or limited. Website information, testimonials, before-and-after images, procedure descriptions, prices, and simulator outputs are illustrative and do not guarantee candidacy, safety, cost, timing, recovery, or results.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lift Plastic Surgery PLLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from your unlawful misuse of the digital Services, violation of these Terms, infringement of another person’s rights, or submission of information you were not authorized to provide. This section does not require a patient to indemnify us for our own professional negligence or for liability that cannot legally be shifted.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFT PLASTIC SURGERY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE WEBSITE OR DIGITAL SERVICES, INCLUDING LOSS OF DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. Any aggregate limitation applicable to a digital-service claim will be the greater of the amount you paid specifically for the affected digital service during the six months before the event giving rise to the claim or USD $100. This limitation does not apply to payment obligations, privacy or security obligations that cannot be limited, personal injury caused by professional negligence, willful misconduct, gross negligence, or any liability that applicable law does not permit us to exclude or limit.

17. Termination

We may suspend or terminate access to the digital Services if you violate these Terms, create a security or safety risk, misuse systems, fail to meet applicable requirements, or when suspension is required by law. You may stop using the website at any time. To terminate SMS messages, reply STOP. Ending website or SMS use does not automatically cancel an appointment, procedure, payment obligation, membership, or patient relationship; follow the applicable cancellation process. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property rights, disclaimers, limitations, indemnification, governing law, and records needed for legal or healthcare purposes.

18. Governing Law and Dispute Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law applies. Any lawsuit concerning the website or digital Services must be brought in a state or federal court in Texas with proper jurisdiction and venue, unless applicable law requires otherwise. Before filing a non-urgent claim, the parties are encouraged to provide written notice and attempt in good faith to resolve the matter informally. Nothing in this section limits rights or procedures that cannot be waived under applicable healthcare, consumer-protection, privacy, or professional-liability law.

19. Changes to These Terms

We may update these Terms to reflect changes in law, technology, Services, or business practices. Updated Terms will be posted at the Terms of Service URL with a revised effective date. Continued use after the effective date means you accept the revised Terms, except where additional notice or consent is legally required. Changes do not retroactively expand SMS marketing consent; we will obtain new consent when required.

21. Final Consent and Acknowledgment

By using the Services, you acknowledge that you have read and agree to these Terms and have reviewed the Privacy Policy. If you submit a form electronically, your submission may constitute an electronic record and signature to the extent permitted by law. Your acceptance of these Terms does not by itself authorize marketing text messages.
